Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and BoatPix AI (“BoatPix,” “we,” “us”) for using boatpix.ai and the BoatPix AI app (the “Service”). By creating an account, signing in, starting a free trial or subscribing, you agree to these Terms. If you use the Service for a dealership or other business, you agree on its behalf and confirm you can bind it, and “you” means that business. The Service is for businesses, and you must be at least 18 to use it.

1. What the Service does

BoatPix uses artificial intelligence, through our AI partner, to change the setting around a boat in your photos: putting it on the water and changing the background, sky, season and light. Results are made by AI and can contain mistakes, including changes to the boat itself. Boat Match and our other checks help catch them, but they can’t catch everything.

2. You’re responsible for your listings

Before you use a result in a listing, an ad or anywhere else, review it and make sure it shows the boat accurately: its make and model, color, lettering, engines, equipment and condition, including any damage or wear. Don’t use the Service to hide a defect or misrepresent a boat. Results are digitally altered images, and you’re responsible for saying so wherever the law, a marketplace, a listing service or your own policies require it. Exports can include a “Background digitally enhanced” note and an original photo for this. You decide what to publish, and you’re responsible for it.

3. Your photos

You keep all rights in the photos you upload and the results you download. You give us permission to process them only to provide the Service. Only upload photos you own or have the right to use. Our privacy page explains how photos are handled, including that our servers don’t keep them.

4. Your account

You sign in with a code sent to your email, so keep that email account secure. You’re responsible for what happens under your account. Tell us right away at support@boatpix.ai if you think someone else has used it.

5. Free trial

New accounts get a free trial for one boat (up to 24 photos, redos included), with 2 redos per photo. One free trial per dealership. We may change or end the free trial offer at any time.

6. Plans, renewal and billing

Paid plans are billed in advance through Stripe, monthly or yearly. Your plan renews automatically at the end of each period, at the price then in effect, until you cancel.

Boats. A boat is one unit for 90 days and includes every photo of it, up to 40 photos put on the water (interior photos don’t count). Each plan includes a number of boats per billing month. Unused boats don’t roll over. Past your plan’s boats, each new boat is billed at your plan’s extra-boat price ($15 on Starter, $10 on Dealer, $9.50 on Pro) on your next monthly invoice.

Redos. Each photo includes 2 free redos. Each redo after that is $0.35, billed on your next monthly invoice. The app tells you before you start an extra redo, and you’re charged only if it finishes.

Your limit. Extra boats and extra redos together are capped each month at the dollar limit you choose in the app ($100 unless you change it). When you reach it, the app stops and asks before anything more is charged.

Unlimited. The Unlimited plan covers one dealership location, with fair use up to 150 boats a month. It has no extra-boat charges; extra redos are billed as above.

Plan changes take effect right away, and the difference for the rest of the period is charged or credited at once. Prices are in US dollars and don’t include taxes, which are added where required. If a payment fails, we may pause processing until it’s fixed.

7. Cancelling and refunds

You can cancel any time in the app, under Plan. Your plan keeps working until the end of the period you’ve paid for (for a yearly plan, the end of the year) and then doesn’t renew. Payments aren’t refundable, including for partly used periods and unused boats, except where the law requires a refund or we choose to give one.

8. Price changes

We may change our prices. We’ll email you at least 30 days before a change affects you, and it takes effect at your next renewal. If you don’t want to pay the new price, cancel before then.

9. Using the Service fairly

Don’t use the Service for anything unlawful, deceptive or infringing; upload photos you don’t have the right to use; get around plan limits, the free trial or billing (for example, by opening extra trial accounts); share an account outside your dealership; copy, resell or reverse-engineer the Service; or overload or interfere with it, including through automated access.

10. Our Service

We own the Service, including the software, our scenes and the BoatPix AI name and logos. We keep improving it and may add, change or remove features. The Service depends on other companies, such as our AI partner, our hosting provider and Stripe, and it may sometimes be slow or unavailable. We don’t promise it will always be available or free of errors.

11. Suspending or closing accounts

We may suspend or close an account that breaks these Terms, doesn’t pay, or puts the Service or other people at risk. If we close your account for no reason of yours, we’ll refund the unused part of any period you’ve prepaid.

12. Disclaimer

THE SERVICE AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

13. Limit on liability

TO THE FULLEST EXTENT THE LAW ALLOWS, BOATPIX IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, SALES, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

14. Claims about your listings

You’ll defend and hold BoatPix harmless from claims by others that arise from your listings, the photos you upload, or your breaking these Terms.

15. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Missouri, and both of us agree to their jurisdiction.

16. Changes to these Terms

We may update these Terms. If a change is significant, we’ll email you or show a notice in the app before it takes effect. Using the Service after that means you accept the updated Terms.
